Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the website located at https://tactablue.com and any related content, features, products, and services (collectively, the "Site") operated by TactaBlue LLC ("TactaBlue," "we," "us," or "our"), a limited liability company organized under the laws of the State of New York.
PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, our Payments Policy, our Compliance & Restrictions Policy, and our Returns & Warranty Policy, each of which is incorporated by reference. If you do not agree to these Terms, do not access or use the Site.
These Terms contain a binding arbitration provision and a class action waiver in Section 16 that affect your legal rights. Please review that section carefully.

2. Eligibility
You must be at least 18 years of age and capable of forming a legally binding contract to use the Site or place an Order. Certain Products carry higher age requirements under applicable law; for example, handgun ammunition may only be purchased by persons 21 years of age or older. See our Compliance & Restrictions Policy for details. By using the Site, you represent and warrant that you meet all applicable age and eligibility requirements and that all information you provide is accurate, current, and complete.
We do not knowingly permit persons who do not meet the applicable minimum age to create an Account or make purchases. If we learn that a person has used the Site in violation of these Terms, we may cancel any associated Account or Order.
3. Account Registration and Security
Certain features may require you to create an Account. When you register, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your Account information;
- Keep your login credentials confidential and secure;
- Accept responsibility for all activity that occurs under your Account; and
- Notify us immediately at support@tactablue.com of any unauthorized use or suspected breach of security.
You are solely responsible for all activity under your Account. We are not liable for any loss or damage arising from your failure to safeguard your credentials. We reserve the right to suspend or terminate any Account, refuse service, or cancel Orders at our sole discretion, including for violation of these Terms or applicable law.
4. Prohibited Use
You agree not to use the Site, directly or indirectly, to:
- Violate any applicable federal, state, or local law or regulation, or any third-party right;
- Purchase, or attempt to purchase, any Product that you are prohibited from owning or possessing under applicable law, or for delivery to a jurisdiction where the Product is restricted or prohibited;
- Acquire Regulated Products on behalf of any person who is prohibited by law from possessing them (a "straw purchase");
- Purchase Products for unlawful resale, export, or diversion, or in violation of any applicable export-control or sanctions laws;
- Engage in fraud, misrepresentation, or unauthorized use of any payment method;
- Access, tamper with, or use non-public areas of the Site or our systems;
- Introduce viruses, malware, or other harmful code;
- Use any robot, scraper, crawler, or automated means to access, harvest, or monitor the Site without our prior written consent;
- Circumvent, disable, or interfere with security-related features, age-verification measures, or geographic or quantity limits;
- Impersonate any person or entity or misrepresent your affiliation; or
- Use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other party's use of the Site.
We reserve the right to investigate and take appropriate legal action against anyone who violates this Section, including reporting suspected unlawful activity to law enforcement.
5. Regulated Products and Legal Compliance
Some Products we sell are subject to federal, state, and local restrictions. Your purchase and use of these Products is governed by our Compliance & Restrictions Policy, which is incorporated into these Terms. You are solely responsible for knowing and complying with all laws that apply to you and to the destination address. By placing an Order, you certify that you may lawfully purchase, receive, and possess the Products in your jurisdiction. We reserve the right to refuse or cancel any Order, require additional verification, or decline to ship to any address for compliance reasons.
6. Products, Pricing, and Availability
All Products are subject to availability. We reserve the right to limit quantities, discontinue any Product, and refuse or cancel any Order at any time. Product descriptions, images, and specifications are provided for convenience and may contain inaccuracies; we do not warrant that such information is complete, reliable, current, or error-free.
All prices are listed in U.S. Dollars (USD) and are exclusive of applicable taxes and any shipping upgrades unless otherwise stated. Prices are subject to change without notice. Sales tax is calculated at checkout where required by law based on the shipping destination.
Quantity Limits and Reselling. We reserve the right, at our sole discretion and with or without prior notice, to limit the quantity of Products purchased per person, per household, or per Order, and to refuse or cancel Orders that we believe are placed for the purpose of Reselling. We may also decline sales to dealers or resellers. This provision does not apply to approved business, agency, or wholesale accounts that we have expressly authorized.
7. Pricing Errors
Despite our best efforts, Products may occasionally be listed at an incorrect price or with incorrect information due to typographical, technical, or other errors. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel Orders at any time without prior notice, including after an Order has been submitted or confirmed.
If a Product's correct price is higher than the price displayed, we may, at our discretion, either contact you for instructions before shipping or cancel the Order and notify you. If your payment method has already been charged for a cancelled Order, we will issue a refund in the amount charged.
8. Order Acceptance and Cancellation
Your submission of an Order constitutes an offer to purchase, not a binding contract. All Orders are subject to our acceptance. We may, in our sole discretion, accept or decline any Order for any lawful reason, including but not limited to Product unavailability, errors in pricing or Product information, suspected fraud, legal or regulatory restrictions applicable to the Product or destination, failed verification, or limitations on quantities available for purchase.
An Order is not accepted until we send a shipment confirmation. A payment authorization, order acknowledgment, or confirmation email does not by itself constitute acceptance of your Order.
You may cancel or modify an Order at any time before it has shipped by contacting support@tactablue.com or calling +1-347-554-0560. Once an Order has shipped, it can no longer be cancelled or modified, but you may return eligible items in accordance with our Returns & Warranty Policy. We also reserve the right to cancel any Order, in whole or in part, before shipment; if we cancel after you have been charged, we will refund the amount charged for the cancelled portion.
9. Payment
By providing a payment method, you represent that you are authorized to use it and you authorize us (and our third-party payment processor) to charge the full amount of your Order, including taxes and any shipping upgrades, at the time your Order is placed. If your payment cannot be processed, or if an Order is flagged for verification, we may hold, suspend, or cancel your Order. Additional payment terms are set out in our Payments Policy.
10. Shipping, Returns, and Refunds
Shipping and delivery are governed by our Shipping Policy. Returns, exchanges, refunds, and warranty matters are governed by our Returns & Warranty Policy. Title and risk of loss pass to you upon our delivery of the Products to the carrier, subject to the lost, stolen, and damaged-shipment protections described in our Shipping Policy.
11. Intellectual Property
The Site and all Content, including the TactaBlue name, logo, and trademarks, are owned by or licensed to TactaBlue LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without our prior written permission. Product names, brands, and logos of third parties are the property of their respective owners.
12. Third-Party Links and Services
The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.
13. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Products may be covered by a manufacturer's warranty as described in our Returns & Warranty Policy; TactaBlue itself makes no independent product warranty. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TACTABLUE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCTS, whether based in contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages. You assume all responsibility and risk for the proper, lawful, and safe selection, handling, use, and storage of any Product you purchase.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or any Product will not exceed the greater of (a) the amount you paid to us for the Product giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless TactaBlue LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your purchase or use of any Product, your violation of these Terms, or your violation of any law or third-party right.
16. Governing Law and Dispute Resolution
Governing Law. These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
Informal Resolution. Before initiating any arbitration or legal proceeding, you agree to first contact us at support@tactablue.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration. Except as otherwise provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Site that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be seated in Kings County, New York, and may be conducted by videoconference or by another method the arbitrator directs. Judgment on the arbitration award may be entered in any court of competent jurisdiction. This provision is governed by the Federal Arbitration Act.
Class Action Waiver. YOU AND TACTABLUE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
30-Day Right to Opt Out of Arbitration. You may opt out of the binding-arbitration and class-action-waiver provisions of this Section by emailing support@tactablue.com with the subject line "Arbitration Opt-Out" within thirty (30) days of the date you first agree to these Terms. Your notice must include your name, the email and mailing address associated with your Account or Order, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms, and if you opt out, any dispute will be resolved in the courts identified below.
Time Limit on Claims. To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms, the Site, or any Product must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred.
Exceptions. Either party may bring an individual claim in the small-claims court of Kings County, New York, if it qualifies, and either party may seek injunctive or equitable relief in the state or federal courts located in Kings County, New York, to protect its intellectual property or confidential information. You consent to the personal jurisdiction of, and venue in, those courts for such purposes.
17. Copyright Complaints (DMCA)
We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, you may submit a written notice to our designated copyright agent that includes: (a) your contact information; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material on the Site that you claim is infringing and its location; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Send copyright notices to support@tactablue.com with the subject line "DMCA Notice." We may remove allegedly infringing material and terminate the accounts of repeat infringers.
18. Changes to These Terms
We may modify these Terms at any time by posting the revised version on the Site and updating the "Last updated" date. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
19. Termination
We may suspend or terminate your access to the Site or your Account at any time, with or without cause or notice. Upon termination, the provisions of these Terms that by their nature should survive—including Sections 5, 11, 13, 14, 15, and 16—will survive.
20. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
21. Entire Agreement
These Terms, together with the policies referenced herein, constitute the entire agreement between you and TactaBlue LLC regarding the Site and supersede all prior agreements and understandings.
